1. Agreement to these terms

These Terms of Service ("Terms") govern your use of evryeleven.com (the "Site"), operated by evryeleven ("evryeleven", "we", "us"). By visiting the Site or contacting us through it, you agree to these Terms. If you do not agree, please do not use the Site.

2. Who we are

evryeleven is a web design and build studio. We redesign, design, build, and animate websites for clients. You can reach us at team@evryeleven.com, support@evryeleven.com, or (832) 786-8903.

3. Our services

The Site describes the services we offer. Nothing on the Site is a binding offer. Specific project work (scope, deliverables, timeline, pricing, and ownership of deliverables) is governed by a separate written agreement or proposal between you and evryeleven. If those documents conflict with these Terms, the project agreement wins for that project.

4. Inquiries and proposals

When you submit the contact form, you ask us to get in touch about a potential project. Submitting the form does not create a client relationship, an engagement, or any obligation on either side. Estimates we share before a signed agreement are informational and may change.

5. Intellectual property

The Site, including its design, code, graphics, animations, text, and the evryeleven name and mark, is owned by evryeleven and protected by copyright, trademark, and other laws. You may browse the Site and share links to it. You may not copy, reproduce, republish, scrape, frame, or create derivative works from the Site's design or code without our prior written permission.

Ownership of work we produce for clients is defined in each project agreement.

6. Acceptable use

• Don't use the Site in a way that breaks the law or infringes anyone's rights.
• Don't attempt to disrupt, overload, probe, or gain unauthorized access to the Site or its infrastructure.
• Don't use the contact form to send spam, malware, or unlawful content.
• Don't misrepresent who you are when contacting us.

7. Third-party services and links

The Site may link to or rely on third-party services (for example, our form-delivery and hosting providers). Those services have their own terms and privacy practices, and we are not responsible for them.

8. Disclaimer

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Site will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the fullest extent permitted by law, evryeleven will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars ($100). Liability for client project work is addressed in the applicable project agreement.

10. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Site after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Any dispute relating to the Site will be resolved in the state or federal courts located in Harris County, Texas.
